By accessing or using GrocerScout (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
GrocerScout is a grocery price comparison and deals aggregation service available in the United States. Coverage and participating stores vary by area. Deals data is sourced from publicly available retailer weekly ads and may be inaccurate, incomplete, or out of date. You should verify prices in-store before relying on them.
You are responsible for maintaining the security of your account. You must provide accurate and current information. We may suspend or terminate accounts that violate these Terms. You may permanently delete your account at any time in the app under Settings → Subscription & Account.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use only.
You agree NOT to:
(a) Copy, reproduce, modify, distribute, publish, transmit, license, sell, or exploit any portion of the Service, including its source code, design, user interface, layout, branding, content, or visual elements.
(b) Reverse engineer, decompile, disassemble, or attempt to derive the source code of any portion of the Service.
(c) Use any robot, spider, scraper, automated tool, or AI agent to access, copy, extract, or monitor the Service or its data without our prior written consent.
(d) Reproduce, redistribute, republish, or commercialize the deals data, price information, or any other content presented in the Service in any form or medium.
(e) Frame, mirror, or otherwise embed the Service or any portion of it on another website or app.
(f) Bypass or circumvent any technical, security, or access control measures, including invite codes and subscription requirements.
(g) Use the Service or its data to build a competing product or service.
(h) Submit false bug reports, spam, or other abusive content, or share your account credentials with others.
All intellectual property rights in the Service — including code, design, trademarks, content, features, and functionality — are owned by GrocerScout or its licensors. These Terms grant no ownership rights to you. Deals data sourced from third-party retailers remains the property of those retailers; GrocerScout's compilation, categorization, and presentation of that data is our intellectual property.
The Service may require a paid subscription. During the beta period, the Service may be provided free or at reduced cost via invite codes. Pricing is subject to change with reasonable notice. Subscriptions are purchased and billed through the Apple App Store or Google Play and are also governed by the applicable store's terms. You may cancel at any time in your store's subscription settings; cancellation stops future renewals but does not refund the current billing period. Deleting your GrocerScout account does not cancel a store subscription — cancel it in your store settings first. Refunds for store purchases are handled by Apple or Google under their policies; GrocerScout cannot issue refunds for purchases made through the stores.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that prices shown are current, accurate, complete, or available at any specific store. Always verify prices in-store before purchasing. We are not responsible for retailer pricing errors, stock-outs, or any decisions you make based on information from the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROCERSCOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY. Our total aggregate liability for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) $50.
We may terminate or suspend your access at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 8, 9, 11, 13, and 14 survive termination.
We may update these Terms at any time. Material changes will require re-acceptance. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction there.
If you download GrocerScout from the Apple App Store or Google Play, you acknowledge and agree that:
(a) These Terms are between you and GrocerScout only, not with Apple Inc. or Google LLC ("App Providers"). GrocerScout, not the App Provider, is solely responsible for the Service and its content.
(b) The App Provider has no obligation to furnish any maintenance or support services for the Service.
(c) The App Provider is not responsible for any product warranties, whether express or implied. In the event of any failure of the app to conform to any applicable warranty, you may notify the App Provider, and (where applicable) the App Provider may refund the purchase price; to the maximum extent permitted by law, the App Provider has no other warranty obligation with respect to the Service.
(d) The App Provider is not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
(e) The App Provider is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service infringes that third party's intellectual property rights.
(f) You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
(g) Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, the applicable App Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
(h) Your use of the Service must also comply with the applicable App Provider's terms of service and usage rules.
